One-Page Kit Licence Agreement

Have a lawyer read this before you sell under it. It is written to be

clear and to say what you actually mean, but it has not been reviewed by

anyone qualified, and clause 3 is the one that matters commercially.

By downloading, installing or using the One-Page Kit ("the Kit") you agree to these terms. If you do not agree, do not use the Kit; tell us within 14 days and we will refund you.

1. What you are buying

The Kit is software: a site generator, six page templates, sample data and documentation. You are buying a licence to use it, not ownership of it. We keep the copyright.

Your licence is perpetual. It does not expire and there is nothing to renew. It is non-exclusive; we license the Kit to other people too.

2. What you may do

• Install the Kit on any computer you control.
• Use it to build an unlimited number of websites, for yourself or for

clients, and charge whatever you like for that work.

• Modify the templates and the generator to suit your own work.
• Keep using it forever, including versions you have already downloaded, even if

this licence later ends under clause 7.

The websites you build are yours. We claim no ownership of, and no rights over, any site produced with the Kit, and no share of what you charge for it. Your client's site is between you and your client.

3. Territory: Ghana is excluded

This licence is valid worldwide except in the Republic of Ghana.

Specifically, you may not:

• use the Kit to build, or help build, a website for a business that is

located or trading in Ghana;

• offer, market, resell or sublicense the Kit, or any service based on it, **to

customers in Ghana**;

• act as an agent, reseller or subcontractor for anyone doing either of the

above.

This is not arbitrary. We operate a website service for Ghanaian businesses using this same code, and that service is how the Kit came to exist and how it continues to be maintained. Everywhere else in the world is yours without restriction.

At checkout you are asked to state the country your business operates in. Ghana is not offered. Stating another country while intending to operate in Ghana is a breach of this clause and ends your licence under clause 7 without refund.

If you genuinely need Ghanaian rights, write to us. We may license them separately. Do not simply proceed and hope.

4. What you may not do

• Resell, redistribute, publish, give away or sublicense the Kit itself, in

original or modified form. This includes uploading it to a public repository, a file-sharing service or another marketplace. (Building sites with it is the point. Passing it on is not.)

• Remove or obscure copyright notices in the source.
• Present the Kit, or a modified version of it, as your own product for sale.
• Use your licence key on behalf of another business so that they avoid buying

their own.

One licence covers one person or one company. If your studio has four people building sites, that is one company and one licence. If you and a friend run separate businesses, that is two.

5. Licence key

You receive a licence key at purchase. It identifies your licence for updates and support. Keep it. Sharing it publicly, or using it to give others access to the Kit, is a breach of clause 4.

6. Updates, support and what we do not promise

• Updates: we may release fixes and improvements. While we do, you get them

at no extra cost. We do not promise any particular update, or any at all.

• Support: email only, one reply within two working days, on questions about

the Kit itself. We do not debug your client's site, write custom templates, provide hosting, or take on work for your clients.

• No warranty. The Kit is provided "as is". We do not warrant that it is

free of defects, fit for any particular purpose, or that it will meet your requirements or your client's.

• Liability. To the fullest extent the law allows, our total liability under

this licence is limited to what you paid for it. We are not liable for lost profits, lost business, lost data, or any indirect or consequential loss.

You are responsible for what you publish. That includes the accuracy of any content on sites you build, and compliance with the privacy, consumer and data-protection law of wherever you and your clients operate. The Kit does not include legal drafting and the sample content is not legal advice.

7. Ending this licence

This licence ends immediately if you materially breach it, including any breach of clause 3 or clause 4. On termination you must stop using the Kit and delete your copies.

Sites you have already built for clients before termination are unaffected. Your clients did nothing wrong and we will not pursue them.

We may end this licence for breach without refunding you.

8. Refunds

Because the Kit is delivered in full at purchase, refunds are at our discretion. In practice, if you have not downloaded it, or you downloaded it and it does not work as described, ask within 14 days and we will refund you. If you have used it to build client sites, we will not.

9. Law

This licence is governed by the laws of the Republic of Ghana, and the courts of Ghana have exclusive jurisdiction. Nothing here removes any right you have under the mandatory consumer law of your own country that cannot be waived by agreement.
